Durham Tees Valley Airport returns to court over bmibaby claim
30.12.09
Durham Tees Valley Airport will return to court next month in an attempt to overturn a decision in its unsuccessful claim against bmibaby. The hubs owner, Peel Airports, has launched an appeal against the airline after losing a £12 million claim for damages earlier this year.
The airport claimed bmibaby was in breach of contract, after it withdrew its Heathrow service from Durham Tees Valley in 2006, severing Teesside’s direct flight link with London. But a High Court judge deemed the terms of the contract too vague to be enforceable, leaving the airport with a £1 million legal bill. The airport wants to recover its legal fees if the appeal is successful.
