BAA to fight airport sale order

BAA said that it will continue flight the forced sale of Stansted and either Glasgow or Edinburgh. The Court of Appeal yesterday reinstated a Competition Commission ruling last year that BAA must sell two airports in the latest twist in a long-running dispute over the possible break-up of BAA.
BAA sold Gatwick last December for £1.5 billion to US firm Global Infrastructure Partners but was also ordered to sell Stansted and one of its Scottish airports in March last year. It successfully appealed against that order arguing that there was ‘apparent bias’ in the ruling because an inquiry panel member had links to Manchester Airport, which at the time was a possible bidder for Gatwick.
The Court of Appeal overruled the previous decision made by the Competition Appeal Tribunal yesterday, saying it was wrong to find ‘apparent bias’. It restored the Commission’s original decision, and the forced sales appeared to be back on. However, BAA has said it would be seeking permission to appeal to the Supreme Court. It has 28 days to lodge an appeal.
